2. Definitions

5. Payment Terms

  • All payments are processed through our authorized payment partners or verified merchant accounts.
  • Clients must pay the full invoice or approved payment plan before project initiation unless otherwise stated in writing.
  • Payment confirms acceptance of these Terms and authorizes the commencement of project activities.
  • Declined or reversed payments will place a temporary hold on services until resolved.

6. Refund and Cancellation Policy

6.1 Refund Eligibility

  • Refunds apply only when no work has started and no deliverables have been produced.
  • Once consultation, research, or production work begins, refunds are not permitted.
  • Refunds are not available for changes of mind after project initiation.
  • Administrative and setup fees remain non-refundable in all cases.

7. Chargeback Policy

  • All payments are final once the project begins.
  • Initiating a chargeback after work has started constitutes a breach of contract.
  • If a chargeback is filed without valid cause, Publishers Crew reserves the right to suspend services, recover the full project cost plus administrative and legal fees, and report the claim to the payment processor and legal authorities.
  • All communications and deliverables are recorded as proof of service for any dispute.

8. Author Responsibilities

  • Provide accurate and complete information for manuscripts, instructions, and promotional materials.
  • Secure rights to submitted content, including copyright and third-party permissions.
  • Publishers Crew is not liable for any copyright infringement or misrepresentation by the Author.
  • Provide timely approvals and submissions to avoid project delays.

9. Intellectual Property

  • Authors retain full ownership of their manuscripts and all creative content.
  • Publishers Crew reserves limited rights to use cover designs, titles, and marketing materials for portfolio and testimonial purposes unless the Author opts out in writing.
  • The Author grants the Company a non-exclusive, revocable license to use project materials strictly for fulfillment and marketing representation.

10. Service Delivery Timeline

  • Timelines vary based on project complexity and service type.
  • Estimated completion times are good-faith projections and not guarantees.
  • Delays caused by client inaction, missing materials, or third-party issues may result in revised delivery dates.

11. Limitation of Liability

  • Publishers Crew shall not be liable for indirect, incidental, or consequential damages related to service outcomes or use.
  • We do not guarantee book sales, reviews, rankings, or commercial performance.
  • Liability for any direct damages is limited to the total amount paid by the Client for that specific project.

12. Confidentiality

  • Both parties agree to maintain confidentiality of all sensitive or proprietary information.
  • Manuscripts, client data, and unpublished materials are shared only as necessary to complete agreed services.
  • All employees, contractors, and vendors are bound by NDAs.

13. Marketing and Advertising

  • Authors understand that marketing performance varies due to numerous uncontrollable factors.
  • All advertising complies with Google Ads and platform-specific policies on accuracy and data protection.
  • We maintain full transparency in all marketing claims and promotional representations.

14. Data Privacy

All personal data is handled per our Privacy & Transparency Policy, which complies with Google Ads, GDPR, and CCPA standards. We never sell, lease, or misuse personal data for unauthorized purposes.

15. Termination

  • The Company may terminate services in cases of non-payment, unprofessional conduct, or policy violation.
  • Upon termination, any outstanding balance becomes immediately due.
  • No refunds apply for work already completed or underway.

16. Legal Terms

16.1 Dispute Resolution

Disputes will first be addressed through written communication, followed by mediation or arbitration if necessary.

16.2 Liability & Indemnification

The Company is not responsible for indirect or consequential damages. Clients agree to indemnify and hold Publishers Crew harmless against any claims arising from their actions or materials.

16.3 Force Majeure

The Company is not liable for delays due to circumstances beyond its control, such as natural disasters, legal restrictions, or system outages.

16.4 Governing Law

These Terms are governed by the laws of Texas, USA.

16.5 Jurisdiction

Both parties agree that any disputes will fall under the exclusive jurisdiction of courts located in the State of Texas.
